I've just commited to virtual paper what I think is the most insane RPG table ever. Excluding the FATAL tables but they won't be published. It randomly selects a crime for your Defendant to have commited in Tough Justice. All of these crimes carried the Death penalty in 18th Century England.

That seems to have been the argument. "Just look at 'im, a child of five knows he's up to
something" as a hanging offense is, in my opinion, horrific, but the thinking behind it is not incomprehensible.

I've come across references that say the offense was actually "blacking the face or using a disguise whilst committing a crime". So, a little fairer than just hanging you for blacking your face at night, but I suppose you could still be hanged for wearing a kerchief while stealing an apple.
Hey I never said it was a historically accurate game.
Generally the whole thing is calculated to have some farcical fun with the period.
It's my most serious game but it's also one of my funniest.

That's a pretty clever law, then, because it puts the criminals in the position of a tough choice: if stealing an apple isn't a hanging offense, but stealing an apple while in blackface is, that means you have to decide between stealing it normally and risking someone recognizing you (increasing your chance of being caught), or stealing it in blackface, where you decrease the chance of being caught but if you are you'll hang.
