Title: SONNUVA BITCH! I've been robbed AGAIN!
Post by: jdrakeh on June 21, 2007, 08:46:14 PM
Well, FedEx dropped off my PC mainboard with a total stranger (non-resident) who happened to be hanging around my apartment complex this afternoon. Fuck them both. I have a printout of the thief's 'signature' (just a chicken scratch) and purported residence (not the delivery address). If it doesn't hang the thief, it'll certainly damn the FedEx driver and put him out of a job. Meanwhile, I'll be filing a claim with FedEx, a police report with PD for fraud and theft (for the guy who walked off with my package), and a mail fraud report with the Post Office.

Fuck. My PC just gets to remain broken, I guess. :(

Man that sucks.  I've been there though and had almost the same thing happen to me.  A UPS driver simply sat the package down in front of our door while nobody was there and left.  Then somebody else walked off with it.  I can't believe the stupity of some delivery drivers nowdays.

Well, I've spoken to FedEx who tried to deny any responsibility (I'm slowly working my up the corporate ladder there) and filed a police report in pursuit of felony mail tampering, misdemenor theft, and misdemeanor impersonation charges. The police will also apparently be following up with FedEx to obtain their own copies of the archived signature and to speak with the driver (to confirm identity of the thief). Incidentally. . .

The thief returned the package -- torn open (and, thus, voiding my warranty) of course. They uncerimoniously dumped it on my doorstep after tearing it open and realizing that it didn't contain something easily hocked at the neighborhood pawnshop. That said, the police assure me that this doesn't make up for stealing it in the first place (nor tampering with it), and I'm inclined to agree. I'm surely pressing charges.

As soon as I get two more paychecks under my belt, I'm also moving out of this dump and into a place where I don't have to worry about my neighbors robbing me blind.

It is possible to affordably sue FedEx over this by going through Small Claims Court. Were it me, I'd look into that option.

I had almost exactly the same thing happen in the block I used to live in. It had a security entry phone at the front door and a set of buzzers, but the buzzers were loud enough that you could hear them in the other flats.
My upstairs neighbours, who were out on police bail for stealing my post and identity, heard the buzzer as the delivery driver rang, went downstairs to the front door claiming the phone was broke and signed for my new motherboard with an illegible scribble.

When I went to the depot they said "a woman came down and signed for it" and declaimed responsibility as they had a signature.
I went to the police and explained things, she being the only woman in the block, they went and had words.

I had words with my supplier, because they'd sent the board to my billing address not my delivery address (work), and their courier had been negligent in not delivering to my door. The next day another neighbour knocked and said he'd found this torn open package with my name on it laying out the back. I turned that over to the police as evidence.

The supplier said I'd have to get the board back from the police and return it to them before they'd send me a replacement. I called Visa who stopped payment.

Never did hear if the police ever prosecuted, partly because the neighbours skipped bail, but I did get a demand from the supplier a month or two later for payment for the mobo that was still in a police evidence bag somewhere. I sent them a short note with the crime reference and address of the local station :)

And I made sure I disconnected my door buzzer when I went out.

Good news! The mainboard, despite having a voided warranty due to the crazy bitch next door opening it, works. So, here's hoping that it works for a good, long, while! :D

When I lived in an apartment, I was very careful to check the delivery method used by the place I was buying from, and would only purchases things that would be shipped via certain carriers. Many places would simply drop your package off in front of the mail boxes in the lobby, where any one of your neighbors could walk off with it. It was very frustrating, and for the most part I would hardly buy anything online.

Glad to hear that you got your package in the end, and that it appears to be working.

I'm curious what would have happened, hypothetically, if you hadn't got it. Would Fed Ex have ponied up in the end? Or would they have tried to screw you over denying any responsibility?

I'm sure FedEx would have tried to deny any responsonsibility (they had already made noises to that effect), though in the end they would have paid (the upside of being related to multiple collections attorneys).
