After Mistwell posted his quote, he provided no sources, so I went and looked up the court documents on my own -- as part of my own fact-checking. I posted the link to the court documents earlier, and cited exactly where I was quoting from.

I am not sure if you're just an idiot, an asshole trolling, or both. Based on experience, both. JKhim provided the ENTIRE CONTEXT over the past couple days, not just links to articles, after I had posted a direct quote from the documents she filed, and not an article. The context is clear and correct. Nobody was posting anything fake. Unquestionable she is asserting the defense that no reasonable person would have believed what she said. The full context was actually worse than that simple statement. Again, not MSM, we pulled from the court documents she filed, directly, with full context.

Powell is basically saying under oath that only an idiot would have believed her words, and then not under oath she is saying "hey idiots, it must be the evil MSM misconstruing the documents I just filed under oath don't believe it!" and the idiots, who she just called idiots for ever believing her words, are again believing her words rather than the literal words she wrote under oath that only an idiot would believe her words.

But don't trust me or JKhim or Sidney or any other link, just fucking read the document she filed under oath yourself and see what you think she's saying. I don't think you can come away still claiming this is just the big bad MSM misconstruing what she's saying.

Minor correction - this is not testimony that Powell swore under oath. The document is written by her lawyers on her behalf - Lawrence J. Joseph, Howard Kleinhendler, and Jesse R. Binnall. I presume that they are trying to give the best defense to their client in making this argument.

You know, I got into a bit of a slapfight with Zak over my hardline assertion that when the lawyers come out, it's time to be publicly quiet and let your motions and arguments in court do the talking (granted, my wording was 'shut the fuck up', although it wasn't specifically directed at him).

That also goes for prosecutors. But the speculation I've seen is that Sherwin doesn't expect many convictions -- so the plan is to drag it out and use the 'process is the punishment' tactic.

I tend to agree about being quieter publicly and letting court actions speak. Far too much goes to the court of public opinion -- where tons of people have a definite opinion about what the outcome of a given court case should be despite not hearing all the evidence that a jury has. There is a place for press to cover ongoing trials, but in general, I think many people are quick to judge on complex trials without crucial details. (And of course, their opinion is usually governed by their politics.)
